Breach of Warranty Claims

The attorneys of MarineLawyers.net have extensive experience and success in prosecuting Breach of Warranty Claims against Vessel Manufacturers in the United States and Foreign Countries. Most Owners don’t realize that they have multiple remedies available to them when a manufacturer or seller violates a warranty. In fact, Vessel Owners have remedies under both State and Federal Law.

Most State Consumer Protection Laws are similar and all states have adopted versions of the Uniform Commercial Code which govern state warranty claims for consumer products. In addition, most consumer protection laws contain language that prohibits "unfair or deceptive practices" such as deceptive advertising and pricing.

The Federal Law governing warranties is entitled the Magnuson-Moss Warranty Act and is the federal law that governs consumer product warranties. The Act requires manufacturers and sellers of consumer products to provide consumers with detailed information about warranty coverage. In addition, it affects both the rights of consumers and the obligations of warrantors under written warranties. The Act makes it easier for purchasers to obtain relief for breach of warranty by making breach of warranty a violation of federal law, and by allowing consumers to recover court costs and reasonable attorneys' fees.

The attorneys at MarineLawyers.net have experience in Federal and State jurisdictions across the United States where we have successfully pursued Breach of Warranty claims, including Breach of Warranty Claims relating to equipment and engines under federal and state law.
